Based on Mercedes Lackey's news announcement, I'd say the particular
Creative Commons License she and her agent are looking for is the Creative
Commons Attribution-Noncommercial-Share Alike 3.0 United States License (or
by-nc-sa for short). Well, technically that's the license that most
fanfiction works fall under, anyway, but it seems they just want things
explicitly stated. In layman's terms, by using the above mentioned license,
you declare that:
1. Mercedes Lackey (and her publisher) is the creator and owner of the
original licensed work.
2. That you agree not to use any or all portion of said original work for
commercial purposes.
3. That your work is a derivative of said original works and that you can
only distribute your work under a similar license as this one (by-nc-sa).
For the full legalese, read this:
http://creativecommons.org/licenses/by-nc-sa/3.0/us/
As for how to use the license, you simply put a note (perhaps in the
disclaimer) stating the terms above. If possible, also link to the relevant
license page (the one I posted earlier). So yeah, it's pretty much the same
thing fanfiction authors have been doing for years, only now we have a page
of valid legalese to use that will hold up in court.
