Section 106 contradicts this, as far as fanfiction is concerned:

the exclusive rights to do and to authorize any of the following:

(2) to prepare derivative works based upon the copyrighted
work;
<snip>"
Since fanfiction could be considered a "derivative work", copyright
law
The only fanfiction to be a derivative work are the ones that retell the
stories using the ORIGANAL WORDS. To my understanding a Derivative Work
needs to include part of the origanal text in it. That also doesn't mean
just a phrase like "Ranma no BAKA". If you Think about it, that phrase,
not being used by VIS, is not even Trademarked. Also Proper names don't
count.

Ergo: To make fanfiction for a certain author or series legal, you
require
the permission
