It probably checks for sentence construction, length, and vocabulary.  A 
higher level does not necessarily mean you're better, but rather that it 
is more difficult to understand.  You don't want it too low, but you 
don't want it too high either, i.e. don't use huge sentences and $10 
words.  You probably want something in the $.10 - $1 words :)   <-SAT level
Word may consider Japanese words and names to be "jargon" and give you a 
higher grade level.  Tax laws and legal code definitely belong into the 
ridiculously difficult to understand category.  Then again, my 
understanding could be all wrong, but given the number of times the 
grammer checker flags stuff, I don't ever bother with it.
